Welcome to MistMatch! These Terms of Service ("Terms") govern your access to and use of the MistMatch mobile application and related services provided by Kotala Digital ("we," "us," or "our"). By using MistMatch, you agree to these Terms. Please read them carefully.

1. Acceptance of Terms

By downloading, installing, or using the MistMatch application, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use MistMatch. We reserve the right to update these Terms at any time, and your continued use after updates constitutes acceptance of the revised Terms.

2. Eligibility

To use MistMatch, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the app under applicable law
• Provide accurate and truthful information when creating your account
• Not have previously been banned from MistMatch

3. Account Registration

When you create a MistMatch account, you agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your password and account credentials
• Promptly notify us of any unauthorized use of your account
• Not share your account with or transfer it to any other person
• Be responsible for all activity that occurs under your account

4. Community Guidelines & Prohibited Conduct

MistMatch is a place for genuine human connection. The following conduct is strictly prohibited:

• Harassment & Abuse: Threatening, bullying, stalking, or harassing other users
• Fake Profiles: Impersonating others, using fake photos, or misrepresenting your identity
• Spam: Sending unsolicited promotional messages or repetitive content
• Illegal Content: Sharing, requesting, or distributing illegal, obscene, or harmful content
• Minors: Any sexual or inappropriate content involving individuals under 18 years of age
• Commercial Activity: Soliciting money, advertising services, or promoting third-party platforms
• Platform Manipulation: Using bots, scripts, or automated tools to interact with the app
• Violence: Promoting, glorifying, or threatening violence against any person or group
• Discrimination: Targeting users based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin

5. User Content

You retain ownership of content you post on MistMatch (photos, bio, messages). However, by posting content, you grant Kotala Digital a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content solely for the purpose of operating and improving MistMatch. You are solely responsible for the content you post and must ensure it does not violate these Terms or applicable law.

6. Subscriptions & Purchases

MistMatch may offer premium features through in-app purchases or subscriptions. By making a purchase, you agree to:

• Pay all applicable fees and taxes
• Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date
• All purchases are processed through the Apple App Store or Google Play Store and are subject to their respective refund policies
• We reserve the right to modify pricing with notice to users

7. Intellectual Property

MistMatch and all associated content, features, and technology are owned by Kotala Digital and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our services without our prior written consent.

8. Privacy

Your use of MistMatch is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand our practices.

9. Disclaimer of Warranties

MistMatch is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the app will be uninterrupted, error-free, or that any matches or connections will meet your expectations. We are not responsible for the actions of other users.

10. Limitation of Liability

To the maximum extent permitted by law, Kotala Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of MistMatch, including but not limited to loss of data, loss of profits, or damages resulting from interactions with other users.

11. Termination

We reserve the right to suspend or terminate your account at any time, without notice, if you violate these Terms or engage in conduct we deem harmful to MistMatch or its users. You may delete your account at any time through the app settings or by contacting us.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of courts in India.
